​Cannabis Production Facilities

The City of Barrie is considering amendments to Zoning By-law 2009-141 to address cannabis production in the City of Barrie as a result of new legislation enacted by the Government of Canada making recreational cannabis legal.

Public Meeting

The General Committee of the Council of the Corporation of the City of Barrie will hold a public meeting on Monday, May 6, 2019, at 7:00 p.m. in the Council Chambers of City Hall, 70 Collier Street, to review municipally initiated amendments to the City of Barrie Zoning By-law 2009-141. 

Purpose of the Proposed Amendments

When the City first considered marihuana production in the context of the Zoning By-law only medicinal marihuana was legal. With the passing of the Cannabis Act (2017) the use of cannabis for recreational purposes as well as medicinal purposes became legal. As cannabis can now be produced and consumed for medical and recreational purposes it is appropriate to explore how this change in the law should be reflected in the City’s Zoning By-law. Retail sales are not being addressed in the proposed changes to the Zoning By-law because Ontario legislation leaves the siting of retail cannabis stores up to the Alcohol and Gaming Commission of Ontario (AGCO).

Nature of the Proposed Amendments

To accommodate the production of cannabis for recreational purposes in addition to the existing permitted production of medical marihuana in the City of Barrie changes in a definition and in a permitted use table in the City’s Zoning By-law are being proposed as outlined below.

  1. Section 3.0 – Definitions

    a) Revise the definition of ‘Medical Marihuana Production Facility’ to ‘Cannabis Production Facility’ with the understanding that both medical and recreational cannabis can be legally produced with a Health Canada License.

    b) Any facility that requires a Health Canada License for the production of Cannabis is to be considered a Cannabis Production Facility under the City’s Zoning By-law, including micro-cultivation licenses, cultivation licenses and licenses for research.
  2. Table 7.2 – Industrial Permitted Uses
     
    a) Rename ‘Medical Marihuana Production Facility’ to ‘Cannabis Production Facility’.

Currently, Medical Marihuana Production Facilities are permitted in General Industrial (GI) zones. The proposed changes through this amendment would result in Cannabis Production Facilities to be permitted in General Industrial (GI) zones.

What happens at the Public Meeting?

There will be a presentation made by City Staff. The meeting will be open to members of the public to express any comments or feedback on the proposed amendment. Members of Council will be able to ask questions of clarification to City Staff. No decision is made at the Public Meeting.

What happens after the Public Meeting?

City Staff will take all of the comments received at the Public Meeting in addition to comments received before the public meeting and will make a recommendation to Council at a later date.
