TAKE NOTICE that the Council of the Corporation of the City of Barrie has passed By-law Number 2024-043 on Wednesday, April 17, 2024 pursuant to the provision of Section 34(18) of the Planning Act, R.S.O. 1990 c. P.13.
AND TAKE NOTICE “that the written and oral submissions received relating to this application, have been, on balance, taken into consideration as part of the deliberations and final decision related to the approval of the application as amended, including matters raised in those submissions and identified within Staff Report DEV011-24”.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal in respect of the By-law by filing with the Clerk of the Corporation of the City of Barrie no later than Tuesday, May 21, 2024 a notice of appeal setting out the appeal to the By-law and the reasons in support of the appeal. The appeal must be accompanied by the fee as prescribed by the Ontario Land Tribunal. The cheque is to be made payable to the Minister of Finance. Please consult the Ontario Land Tribunal’s website (https://olt.gov.on.ca/) or 1-866-448-2248 for further information regarding how to file an appeal, the appeal process and the appeal fee reduction request application.
The purpose of the By-law Number 2024-043 is to amend the Comprehensive Zoning By-law 2009-141 to permit four (4) units on residentially zoned lands. The amendments to the text of Zoning By-law 2009-141 apply City-wide, and include revisions to Section 3.0 Definitions, Section 4.4.2.3 Change in Use, Table 5.2 Permitted uses in the Residential Zone, Section 5.2.9 is renamed to Additional Residential Units, subsections 5.2.9.1, 5.2.9.2, and 5.2.9.3 update the standards for additional residential units, 5.2.9.3 Parking Standards, Section 5.3.5 Accessory Buildings and Structures, Section 5.3.6.1 Parking in Residential Zones, Section 14.5.2 Permitted Uses in Neighbourhood Residential, Table 14.5.2 Permitted uses in the Residential Neighbourhood (R5) and Residential Multiple Neighbourhood (RM3) Zones.
