Public Notice: Passing of By-Law- Decision to adopt a Community Improvement Plan

_TAKE NOTICE of a decision of the Council of The Corporation of the City of Barrie to adopt By-law Numbers 2020-006 and 2020-007 on Monday, January 13, 2020 pursuant to the provision of Sections 28(2) and 28(4) of The Planning Act, R.S.O. 1990, Chap.P.13.

TAKE NOTICE that the written and oral submissions received relating to this matter, have been, on balance, taken into consideration as part of the deliberations and final decision related to the approval of the Community Improvement Plan, as detailed within Staff Report PLN038-19.

TAKE NOTICE that the proposed community improvement plan is exempt from approval by the Ministry of Municipal Affairs and Housing and the decision of council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal. Any person or agency may appeal to theLocal Planning Appeal Tribunal in respect of the By-law by filing with the Clerk of the Corporation of the City of Barrie no later than Wednesday, February 12, 2020 a notice of appeal setting out the appeal to the By-law and the reasons in support of the appeal.  The appeal must be accompanied by the fee of $300.00 as prescribed by the Local Planning Appeal Tribunal.  The cheque is to be made payable to the Minister of Finance.  Please consult theLocal Planning Appeal Tribunal's website or 1-866-448-2248 for further information regarding how to file an appeal and the appeal process.

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.

An explanation of the purpose and effect of the By-law is provided in this Notice and the By-law is available for inspection in the office of the City Clerk between 8:30 a.m. and 4:30 p.m. Monday to Friday.  Further information can also be viewed on the City of Barrie website atPlanning and Development/ Policies-Strategies/ Community Improvement Plan.

Purpose and Effect of the By-Law

The purpose of the By-law Number 2020-006 is to designate a Community Improvement Project Area. The purpose of the By-law Number 2020-007 is to adopt a Community Improvement Plan (CIP). The CIP is established to provide financial incentives to support key planning and growth management objectives, development of affordable housing units across the City, development of a mix of uses within the Urban Growth Centre (UGC) as well as support for built heritage preservation.
