Public Notice: Passing of By-Law- Cannabis Production

_TAKE NOTICE that the Council of the Corporation of the City of Barrie has passed By-law Number 2019-086 on Monday, October 28, 2019 pursuant to the provision of Section 34(18) of The Planning Act, R.S.O. 1990 Chap.P.13.

Any person or agency may appeal to the Local Planning Appeal Tribunal in respect of the By-law by filing with the Clerk of the Corporation of the City of Barrie no later than Wednesday, November 27, 2019. A notice of appeal setting out the appeal to the By-law and the reasons in support of the appeal.  The appeal must be accompanied by the fee of $300.00 as prescribed by the Local Planning Appeal Tribunal.  The cheque is to be made payable to the Minister of Finance.  Please consult the Local Planning Appeal Tribunal's website or 1-866-448-2248 for further information regarding how to file an appeal and the appeal process.

Only individuals, corporations and public bodies may appeal a zoning by-law to the Local Planning Appeal Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.

An explanation of the purpose and effect of the By-law is provided in this Notice and the By-law is available for inspection in the office of the City Clerk between 8:30 a.m. and 4:30 p.m. Monday to Friday.  A key map is provided with this Notice showing the location of the lands affected by By-law Number 2019-086.

PURPOSE AND EFFECT OF THE BY-LAW

The purpose of the By-law Number 2019-086 is to amend By-law Number 2009-141 as follows;

1. That Section 3.0 – Definitions of Comprehensive Zoning By-law 2009-141 be amended by deleting the definition of “Medical Marihuana Production Facility" and replacing it with:

“Cannabis Production Facility" shall mean a wholly enclosed building, structure or part thereof, used to possess, produce, sell, provide, ship, deliver, transport or destroy marihuana or cannabis by a Licensed Producer authorized by Health Canada and through a Licence issued by the City of Barrie, as required. Any facility that requires a Health Canada License for the production of Cannabis is considered a Cannabis Production Facility including micro-cultivation licenses, cultivation licenses and licenses for research.

2. That Section 3.0 – Definitions of Comprehensive Zoning By-law 2009-141 be amended by deleting “medical marihuana production facility" and replacing it with “cannabis production facility" in the current definition of “Manufacturing and Processing".

3. That Table 7.2 – Permitted Uses of Comprehensive Zoning By-law 2009-141 be amended by deleting “Medical Marihuana Production Facility" and replacing it with “Cannabis Production Facility". (File: D14-1667).
