Appeal to a Hearing Officer

Through the Administrative Penalty System, the decision of the Screening Officer can be appealed to a Hearing Officer should an owner feel the decision is not just. The decision of the Hearing Officer is final. Details on requesting an appeal to a Hearing Officer are included in the written decision of the Screening Officer.

Like a Screening Officer, a Hearing Officer has the authority to confirm, reduce and/or provide additional time to pay the Penalty Order. A Hearing Officer can also cancel a Penalty Order should there be credible evidence provided and reason to do so. These reasons are set out in the Administrative Penalty System By-law

It is your responsibility to ensure the authorized representative has any credible or trustworthy documentation they wish to rely upon readily available for the appeal. Although efforts will be made to ensure the authorized representative is sent the time and date of the appeal, it is your responsibility to ensure the authorized representative is aware of the date and time of the appeal. Failure of the authorized representative to appear at the scheduled appeal will result in a $60.00 Non-attendance Fee being added to your Penalty Order. Are you making this request within 30 calendar days of the Screening Officer's decision?

To qualify for an extension of time to appeal, your reasons for not completing this form within 30 calendar days of the Screening Officer's decision date must be beyond your control (for example, a hospitalization). Failure to pay or appeal the Penalty Order within the allotted time may result in late fees being applied to the penalty amount and the Ministry of Transportation of Ontario being notified to prevent renewal of your vehicle plates or issuance of a new vehicle plate.

The Hearing Officer will determine the method your hearing (orally in-person, virtually, or in writing). Notification will be sent by email. Should a virtual meeting be scheduled, the notice of date and time and Zoom connection details will be emailed to you. Failure to attend the scheduled meeting will result in a $60.00 Non-attendance Fee being added to the Penalty Order.

In processing a request for additional time to pay, the Hearing Officer may request to review financial income documentation such as a copy of your previous year’s Canada Revenue Agency Notice of Assessment, other proof of income such as Old Age Security, pension income (CPP, disability or other pensions), student assistance program and any child or spousal support orders.
