  1. Copy of Registered Easement
  2. Survey of Owner(s) property showing easement
  3. Non-refundable application fee of $593.25 HST included, payable to the City of Barrie, in accordance with the City of Barrie fees by-law, as amended from time to time.
  4. Cheque in the amount of $500.00 to be held as a legal retainer.

    Owner's Acknowledgement

    1. As the registered Owner(s) of the property described above, I hereby acknowledge and authorize the following: I agree to promptly pay to the City of Barrie all legal costs, including fees, disbursements and taxes, relating to the preparation and registration of the subject release of easement. These costs are in addition to the application fee as stated above. I acknowledge these costs to be a minimum of $275.00 and will reflect time spent on the matter. The legal retainer will be utilized for this payment and any remaining funds will be returned to the Owner(s).
    2. The City of Barrie’s Solicitor is hereby authorized to register the release of easement.
    3. It is the responsibility of the Owner(s) to confirm the existence of any other utilities that may be located within the subject easement.
    4. The Owner(s), notwithstanding the release of this easement, acknowledges that the release of this easement in no way absolves the Owner(s) of their responsibility to comply with all rules, regulations and laws governing the use of their property, and without limiting the generality of the foregoing, acknowledge that they must comply with all overall drainage/grading plans at all times.
    5. The Owner(s) acknowledge(s) that they must retain their own solicitor for the purposes of completing registration of the Transfer, Release and Abandonment document, as the City of Barrie’s Solicitor cannot complete the statements required in the document for Land Transfer Tax purposes. All legal costs incurred by the Owner to obtaining their own Solicitor are at the sole responsibility of the Owner.
    6. Submission of this application does not guarantee that the easement will/can be released and is subject to staff approval. Any payments made with respect to this application are non-refundable.
